Terms & Policies
RESERVATION POLICIES:
Reservations or requests for services can be made via "Book Now" links on our website, email, phone or the Contact us link on the website.
No trip, tour or other activity provided by Joshua Tree Excursions will be deemed reserved until deposit (if more than 30 days out) or full payment (if within 30 days) for services have been processed. No date will be held more than 48 hrs from invoicing.
Joshua Tree Excursions is under no obligation to hold, reserve or otherwise guarantee dates, services or activities until full payments or deposits have been processed. Simply requesting services on a specific date does not guarantee provision of those services on the date requested; nor that the requested date will be available if requested again in the future.
All requests for services must be requested and confirmed via email or phone. The personalized nature of services provided by Joshua Tree Excursions does not allow for the use of an online booking system for most trips, with the exception of sightseeing tours, special events and trips scheduled by Joshua Tree Excursions.
PAYMENTS:
DEPOSIT: A 50% deposit of total or estimated total, is required to secure your booking with Joshua Tree Excursions. Deposit is fully refundable as long as trip is cancelled 31 days or more prior. 30 days prior to trip, all deposits, payments and other fees become non-refundable. You acknowledge that the deposit is to be paid within 48 hours of receipt of invoice to secure your date. No trip or tour is deemed reserved until deposit is paid. Joshua Tree Excursions will not guarantee tour dates without a deposit, nor can Joshua Tree Excursions guarantee that your dates will be available in the future should you opt to wait. Between 30-0 days before trip, your deposit is non-refundable but transferable to another departure date or trip based on circumstances ( see cancellations ). If your booking is made within 30-days of the departure date then full payment is due to reserve your date.
TRIP BALANCE: You agree to pay the outstanding balance in US Dollars (or the foreign currency equivalent), plus any additional items (multi-day options, single supplements, rental equipment, extra hotel bookings etc.) no later than 30-days prior to the departure date of the trip. You’ll receive a payment reminder by email 7- days before the due date. Any balance not paid by the due date, may result in trip cancellation and forfeiture of all deposits paid.
PAYMENTS: All payments should be made via invoices provided. We accept payment in US dollars. – Our preferred form and easiest method of payment is via PayPal or the invoice which you will receive. You agree and acknowledge that credit cards attract a three percent surcharge and may also be subject to additional fees from your card provider on foreign currency transactions that Joshua Tree Excursions is not responsible for.
HIKING/SINGLE-DAY TOURS:
All hiking trips require a 50% deposit of the total estimated fee for services requested in order to reserve your dates.
Balance due on all hiking trips due 14 days prior to departure date. Deposit becomes non-refundable 30 days prior to trip. Although non-refundable, your deposit may be transferred to another date. Any hiking tour that takes place within 30 days, must be paid in full at time of booking.
All groups exceeding seven, special events, corporate events, retreats, event planning support and location scouting services will be charged an additional 18% for gratuity.
CAMPING/BACKPACKING TOURS:
All camping and backpacking trips require a 50% non-refundable deposit at time of booking to reserve dates and activities. Balance on all camping and backpacking trips is due 30 days prior to departure. Failure to pay final balance by due date may result in the cancellation of your trip and forfeiture of all fees paid. Backpacking trips require a minimum of two participants in order to depart.
CORPORATE EVENTS, LARGE GROUPS, RETREATS, SPECIAL EVENTS:
These events all require a $250 non-refundable event planning and administrative fee plus a deposit of 50% of the estimated total fee is required to hold and reserve your dates. Deposit becomes non-refundable 60 days prior to trip.
CANCELLATIONS
CANCELLATIONS: In the event you need to cancel your trip, the following cancellation policies will apply:
Cancellations for all trips tours and activities made 31+ days prior to departure date – All fees paid to date will be refunded, less any pre-paid trip expenses (special events, sound bath, permits etc.)
Cancellation for any single or multi-day activities made between 30 and 0 days of scheduled departure date – All fees, deposits and payments become non-refundable regardless of circumstances. All fees are fully transferrable to any future trip or tour.
Cancellation of Camping, Backpacking, or other multi-day or large group event/ trip within 30 days of trip results in forfeiture of all fees paid.
A cancellation will be effective when Joshua Tree Excursions receives written notification of the cancellation. This cancellation policy includes voluntary or involuntary early departure from a trip. No refunds will be given for missed or unused services such as accommodation, activities or meals. You are strongly advised to take out cancellation insurance that will cover cancellation fees at the time of booking.
LATE ARRIVAL: Unless previously coordinated, any guest or group that is 30 minutes or more late for their scheduled tour, without notification, will be deemed to have cancelled, abandoned, or forfeited their trip and no refunds will be given.
NO SHOWS: If any member of your group or party is unable to participate, for any reason, no refunds will be provided unless notification of no show is provided within 7 days of departure. Refund will be less any irrecoverable fees.
Guests canceling will have the option of applying or transferring any non-refunded fees to future tours or trips; as long as any such trip is booked and paid for, in full, within 90 days of cancelled trip.
A party will not be in breach of or in default under this agreement on account of, and will not be liable to the other party for, any delay or failure to perform [his][her][its] obligations under this agreement by reason of fire, earthquake, flood, explosion, strike, riot, war, terrorism, park closure or similar event beyond that party’s reasonable control (each a “Force Majeure Event”). However, if a Force Majeure Event occurs, the affected party shall, as soon as practicable:
Notify the other party of the Force Majeure Event and its impact on performance under this agreement; and
Use reasonable efforts to resolve any issues resulting from the Force Majeure Event and perform [his][her][its] obligations under this agreement.
Note: Joshua Tree Excursions reserves the right to refund all, a portion of, or none of, the fees paid for trips or tours, based on the circumstances at the time of cancellation.
CANCELLATION BY JOSHUA TREE EXCURSIONS: We occasionally may have to cancel a scheduled trip at any time, up to and including day of departure, due to unforeseen circumstances: ( weather, hazardous conditions, park closures or other limiting factors related to safety ). If Joshua Tree Excursions cancels your trip for any reason outside of Force Majure , you can transfer any fees paid to an alternate departure date for no additional fee ( based on availability ) or alternatively opt for a full refund. In circumstances where the cancellation is due to events outside our control, such as natural disasters, terrorism or political instability, and we are unable to operate the trip as planned; refunds will be less any unrecoverable costs. Joshua Tree Excursions is not responsible for any incidental expenses that you may have incurred as a result of your booking, including but not limited to lodging, travel insurance excess, or non-refundable flights.
TRAVEL INSURANCE
TRAVEL INSURANCE: It is highly recommended, that when booking with Joshua Tree Excursions, you obtain full travel insurance coverage – please be aware that some insurance companies require insurance to be purchased within 7 days of deposit payment. We recommend that you select coverage that includes full medical, emergency evacuation, and emergency repatriation if required. We also strongly recommend trip cancellation insurance, and insuring against any other travel mishaps such as flight cancellations or delays, loss of luggage and personal effects, theft, or trip interruption at the time of booking. Travel insurance can be obtained through your travel agent or from online brokers. Please contact us for any further advice. Joshua Tree Excursions is not responsible for nor liable for any expenses related to medical emergencies, evacuations, hospital stays, or transportation that are incurred as a result of injuries, accidents, illnesses, or death.
TOUR AGREEMENT
TOUR AGREEMENT: You agree that you’re willing to participate in an outdoor adventure trip and are physically prepared to take part in the activities requested. You understand you’re undertaking a trip that may, at times, be physically and mentally challenging in nature. You have read our client gear list and adhere to our recommendations, and will carry or wear what is suggested by the lead guide on any activity. You understand that the trip may not follow the exact printed itinerary if circumstances don’t allow, although Joshua Tree Excursions is committed to doing everything they can to keep your trip running as close to the scheduled itinerary as possible. It is at the complete discretion of your Joshua Tree Excursions guide to cancel any activity at any moment if there are concerns for the health, safety and wellbeing of the group or any individual. There will be no refunds for activities missed for this reason. Your Joshua Tree Excursions guide can also cancel any individual’s trip at any time at the expense of the individual if they do not adhere to the guide’s instruction or are behaving in a manner that could affect their health, safety and wellbeing or that of others on the trip.
PARK CLOSURES: You agree and understand that areas of the National Park, up to and including the entire public access area are subject to closures at any time, due to circumstances beyond our control, based on a variety of reasons. You agree and understand that Joshua Tree Excursions will NOT cancel trips based on Park closures unless such closures directly impact our ability to provide the services requested. In the event of a main park closure, all scheduled trips will run in areas of the park, public and preserve lands in the surrounding area, not affected by any closures. Should an unlikely closure occur, you understand that the option to cancel or re-schedule your trip is solely at your discretion in accordance with our cancellation policies.
GUEST EXPECTATIONS
The services we provide to our guests are unique in nature and we pride ourselves in giving you the most enjoyable and memorable experience possible. In order to do this, we ask that our guests make every effort to adhere to the following:
1. Please be on time for your tour. While we do not have a strict schedule when it come to our tours, a late start can definitely impact the time available for you to enjoy your experience and may limit the amount of time we have to share the Park with you. We empathize completely, that life happens. So, please, just let us know if you are running late and understand that it may impact your tour. Failure to notify us may result in cancellation or forfeiture of your trip ( see cancellations )
2. Please wear appropriate clothing. We always recommend: Long pants and sleeves, closed toed trail shoes or hiking boots
( absolutely no sandals or flip-flops ) a hat, sunglasses, sunscreen, chapstick and warming layers ( it can cool rapidly ) A daypack and a camera are great options if available.

3. Provide us with an accurate assessment of your abilities, and any injuries or limitations that may effect your ability to participate. Our guides are all experts and will tailor the day to your abilities, interests and expectations, regardless of what they are. However, an honest assessment is critical.
4. Please be sure to bring any required medication. Our tours are conducted in remote locations and access to modern medical facilities is often several hours away. If there are medications that you are required to take daily, please bring a supply with you, just in case.
5. Please let your guide know if you suffer from any allergies ( food, environmental, or otherwise ) or existing medical conditions
( asthma, diabetes, etc ). All of our guides are certified Wilderness First Responders, capable of providing you the best possible wilderness care available should it become necessary. Please advise them of any conditions that they should be on the look-out for.
6. Please let us know at least 48 hrs ahead of your tour what your lunch choices will be and if there are any dietary restrictions or allergies we should be aware of ( Peanuts, Vegetarian, Vegan, Gluten free, etc ). This will ensure that the appropriate meal selection is ordered and ready the day of your tour.
7. Guests are expected to adhere to and follow all National Park policies and regulations while on the tour. If you have questions about regulations and policies, please ask your guide.
8.The following items are prohibited at all times while on a trip or tour with Joshua Tree Excursions: Pets, Fireworks, Drones, and Illegal drugs.
9. Lastly, let us know if there are any considerations, interests or preferences that would make your experience more memorable, special or interesting. If it is possible, we will make it so.
TERMS OF USE POLICY
Please read this agreement ("Agreement") carefully before accessing or using the Joshua Tree Excursions website (29 Trail Tours LLC) (the "Site"). By accessing or using the Site, you agree to be bound by this Agreement. Joshua Tree Excursions and its suppliers provide the information and services on this Site to you, the user, conditioned on your acceptance without modification of the terms, conditions and notices contained herein. Your use of the Site constitutes your agreement to all such terms, conditions and notices.
The information and services offered on the Site are provided with the understanding that neither Joshua Tree Excursions nor its suppliers or users, are engaged in rendering legal or other professional services or advice. Your use of the Site is subject to the additional disclaimers and caveats that may appear throughout the Site.
Joshua Tree Excursions and its agents assume no responsibility for any consequence relating directly or indirectly to any action or inaction that you take based on the information, services or other material on this Site. While Joshua Tree Excursions strives to keep the information on this Site accurate, complete and up-to-date, Joshua Tree Excursions and its suppliers cannot guarantee, and will not be responsible for any damage or loss related to, the accuracy, completeness or timeliness of the information.
PROHIBITED USES
You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, frame in another Web page, use on any other web site, transfer or sell any information, software, lists of users, databases or other lists, products or services obtained from this Site. The foregoing prohibition expressly includes, but is not limited to, the practices of "screen scraping" or "database scraping" to obtain lists of users or other information.
PROPRIETARY RIGHTS
All materials on this Site (as well as the organization and layout of the Site) are owned and copyrighted, licensed by, or used with permission by Joshua Tree Excursions, its affiliates or its suppliers. No reproduction, distribution, or transmission of the copyrighted materials at this Site is permitted without the prior written permission of Joshua Tree Excursions.
NO UNLAWFUL OR PROHIBITED USE
As a condition of your use of this Site, you warrant to Joshua Tree Excursions (29 Trail Tours LLC) that you will not use this Site for any purpose that is unlawful or prohibited by these terms, conditions, and notices. If you violate any of these terms, your permission to use the Site automatically terminates.
DISCLAIMER OR WARRANTIES
You expressly understand and agree that:
(a) YOUR USE OF THIS SITE AND THE SERVICE OFFERED AT THE SITE IS AT YOUR SOLE RISK. THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. JOSHUA TREE EXCURSIONS EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
(b) JOSHUA TREE EXCURSIONS MAKES NO WARRANTY THAT (i) THE SITE OR SERVICES WILL MEET YOUR REQUIREMENTS, (ii) THE SITE OR SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SITE OR THE SERVICES WILL BE ACCURATE OR RELIABLE, OR (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL OBTAINED BY YOU THROUGH THE SITE WILL MEET YOUR EXPECTATIONS.

LIMITATION OF LIABILITY:
YOU EXPRESSLY UNDERSTAND AND AGREE THAT JOSHUA TREE EXCURSIONS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF JOSHUA TREE EXCURSIONS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SITE OR SERVICES; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO ON THE SITE OR THROUGH OR FROM THE SERVICE ; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE ; OR (v) ANY OTHER MATTER RELATING TO THE SITE OR THE SERVICES.
INDEMNIFICATION
You agree to indemnify, defend and hold harmless Joshua Tree Excursions, 29 Trail Tours LLC, its affiliates and suppliers from any liability, loss, claim and expense (including attorneys' reasonable fees) related to your violation of this Agreement.

Joshua Tree Excursions may modify this Agreement at any time, and such modifications shall be effective immediately upon posting of the modified Agreement. MISCELLANEOUS
This Agreement and the resolution of any dispute related to this Agreement or this Site shall be governed by and construed in accordance with the laws of California, without giving effect to any principles of conflicts of law. Failure by Joshua Tree Excursions or its affiliates to insist upon strict enforcement of any provision of this Agreement shall not be construed as a waiver of any provision or right. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of this Site or this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred. Any legal action or proceeding between Joshua Tree Excursions and/or its affiliates and you related to this Agreement shall be brought exclusively in a federal or state court of competent jurisdiction sitting within the State of California.
Joshua Tree Excursions, 29 Trail Tours LLC and other logos, product and service names are trademarks and service marks owned by or licensed to Joshua Tree Excursions or its affiliates (the "Marks"). Without the prior written permission of Joshua Tree Excursions or its appropriate affiliates, you agree not to display or use in any manner, the Marks.
All other trademarks are the property of their respective owners.

2. TYPES OF INFORMATION COLLECTED AND USES OF COLLECTED INFORMATION
We collect two types of information about our “website” Users: Personally Identifiable Information and Non-Personally Identifiable Information.
Personally Identifiable Information (PII), is information that identifies a specific End User. When you engage in certain activities on the Website, such as but not limited to reserving a trip, submitting content and/or posting content on our website, requesting information about our services or applying for a job. (collectively, “Identification Activities”), we may ask you to provide certain personal information about yourself, such as your first and last name, mailing address (including zip code), email address, telephone number and date of birth. It is optional for you to engage in an Identification Activity. If you reserve a trip, we may ask you for additional information. Depending on the activity, some of the information we ask you to provide is identified as mandatory and some is identified as voluntary. If you do not provide the mandatory information for a particular activity that requires it, you will not be permitted to engage in that activity. If you elect to reserve a trip or tour, we will direct you to a third party vendor “PayPal” for payment. They will ask you to provide them with your credit card number, expiration date and authentication codes or related information. Please refer to the PayPal privacy policy for more details. If you choose to reserve a trip or tour for friends, we will ask for and store your friends’ names and email addresses. Your friend may contact us at info@joshuatreeexcursions.com to request that we remove this information from our database.
Joshua Tree Excursions uses Personally Identifiable Information to provide services to you, contact you, enhance the operation of our Websites, improve our marketing and promotional efforts, analyze Website use, improve our service offerings, and to tailor your experience with third parties as provided in Item 3 of this Privacy Policy. If you send our customer service an email, we may use your comments and feedback to tell others about our services, and may post your comment in our marketing materials or on our Website. If your comment contains your name, we will obtain consent from you before publishing it along with your comment. We may also use Personally Identifiable Information to troubleshoot, accomplish administrative tasks, enforce our agreements with you, including our Website, terms of use and this Privacy Policy, comply with applicable law, and cooperate with law enforcement activities. If you reserve a tour for friends, we will send your friends emails with the gifts you bought for them and invite them to visit the site. We may also add their e-mail address to our mailing list. Non-Personally Identifiable Information (NPII) is information that does not identify a specific End User. This type of information may include things like the Uniform Resource Locator (“URL”) of the website you visited before coming to our Website, the URL of the website you visit after leaving our tour company Website, the type of browser you are using and your Internet Protocol (“IP”) address. We, and/or our third party service providers and advertisers, may automatically collect this information when you visit our Website through the use of electronic tools like Cookies and Web beacons or Pixel tags, as described in Items 4 and 8 of this Privacy Policy.
We use Non-Personally Identifiable Information to troubleshoot, administer the Website, analyze trends, gather demographic information, comply with applicable law, and cooperate with law enforcement activities. We may also share this information with our Third party service providers and Advertisers to measure the overall effectiveness of our online advertising, content, and programming.
3. RELEASE OF PERSONALLY IDENTIFIABLE INFORMATION
We will not share, sell, rent, or trade Personally Identifiable Information with other parties except as provided below:
We may share your information with Third Party Service Providers. We provide some services through third parties. These third party service providers perform functions on our behalf, like sending out and distributing our administrative and promotional emails. We may share Personally Identifiable Information with such Service Providers to complete reservation orders, send email, remove repetitive information on customer lists, analyze data, provide marketing assistance, provide search results and links, process credit card payments, operate the Website, troubleshoot, and provide customer service.
Third party service providers may also release your information to accomplish our administrative tasks. For example, when you order a service, we direct you to a third party service provider. The third party service provider will then release your credit card information to the card-issuing bank to confirm payment for the service. We encourage third party service providers to adopt and post privacy policies. However, the use of Personally Identifiable Information by such parties is governed by the privacy policies of such parties and is not subject to our control.
